Terminating Your Tenancy Agreement
Terminating Your Tenancy Agreement
How do I terminate my tenancy agreement?
The way you can terminate your tenancy depends on the type of rental agreement you have.
Tenancy agreement with a minimum rental period of 12 months
If your tenancy agreement includes a minimum rental period of 12 months, you may only terminate the agreement after this minimum period has ended. A notice period of 1 month always applies.
Example:
* Rental start date: January 1, 2025
* Minimum rental period: 12 months
* Earliest possible end date: December 31, 2025
* Notice must be given no later than November 30, 2025
Fixed-term tenancy agreement or after the minimum rental period
If the minimum rental period has passed, or if you have a fixed-term tenancy agreement without a minimum rental period, you may terminate your tenancy at any time, provided you observe a notice period of 1 month.
Example:
* You submit your notice on May 15
* Your tenancy ends on June 15
How do I give notice?
You can only terminate your tenancy by e-mail:
info@smitsrealestate.nl
Your notice will only be considered valid once you have received a confirmation e-mail from us acknowledging receipt.
What happens after I give notice?
After receiving your notice, we will schedule a preliminary inspection.
During this inspection:
* We will take new photographs of the property for re-letting purposes. So make sure the space is tidy and clean.
* We will identify any items that need attention before the final inspection.
* We will explain the requirements for the key handover.
To ensure a smooth final inspection and key handover, please carefully follow our departure guidelines.

When will I receive my security deposit?

Important:
* Deregister from the municipality before moving out.
* Send us your proof of deregistration from the Municipality of Maastricht.
* Ensure that all outstanding obligations have been fulfilled.
Once we have received your proof of deregistration and the final inspection has been approved, we can process the return of your deposit.
